Another Amazon warehouse in New York is seeking to unionize

Workers at an Amazon warehouse in a town located southeast of Albany, New York have filed a petition with the National Labor Relations Board to hold a union election. The warehouse, with the codename ALB1, is hoping to join the Amazon Labor Union, which successfully convinced majority of workers at the company's JFK8 facility in Staten Island to vote in favor of unionizing earlier this year. An NLRB spokesperson told CNBC that the agency's office in Buffalo is currently verifying whether the group has truly met the minimum number of signatures needed to hold an election.

Unions typically need to get signatures from 30 percent of eligible members to be able to hold a vote. According to The Washington Post, the ALU previously said that it had passed that threshold for the Albany warehouse. Union organizers at the facility have been working on joining the ALU for months. After Amazon noticed their efforts, the company reportedly held meetings to discourage workers from unionizing. An employee also sent us photos of digital TVs at the Albany facility displaying anti-union messages. To be precise, the messages discouraged people from signing a "card" from the ALU, pertaining to the authorization cards workers have to sign for the warehouse to be able to hold a vote.

The ALU has been demanding for higher pay and safer working conditions for warehouse workers and has previously accused the company of retaliation. A few weeks after it won the election in Staten Island, Amazon fired two of the employees who were involved in its organization efforts. Their fellow organizers believed that it was a retaliatory move by the e-commerce giant. Heather Goodall, a lead organizer at ALB1, said: "The main concerns I hear from workers are about wages and safety. Besides that, there’s no job security. There’s no way to rest on a 15-minute break. Workers want to be able to use the bathroom freely."

Amazon has long made it clear that it is against workers' unionization efforts. A spokesperson told The Post: “As a company, we don’t think unions are the best answer for our employees. Our focus remains on working directly with our team to continue making Amazon a great place to work." The company also appealed ALU's victory in Staten Island, accusing organizers of pressuring workers to vote in favor unionizing. A hearing for Amazon's appeal could be announced sometime this month.

Amazon VP tries to convince sellers to oppose antitrust bill

Amazon made an appeal to its third-party sellers to oppose a Senate antitrust reform bill aimed at helping their businesses. In a post on Amazon’s internal forum for third-party merchants, the company’s vice president of worldwide selling partner services Dharmesh Mehta urged sellers to oppose The American Innovation and Choice Online Act (S.2992), and asked them to contact their senators.

"As we have noted in previous communications to you throughout the past year, Congress is considering legislation, including S. 2992, the American Innovation and Choice Online Act, that could jeopardize Amazon’s ability to operate a marketplace service and, as a result, your business’s ability to sell in our store," wrote Mehta. 

Just under 500 sellers have responded to Mehta’s post since Thursday, many of them unconvinced by Amazon’s claim that the Senate bill will harm their businesses. “The bill jeopardizes the way Amazon wants to operate. It would not jeopardize marketplaces. Amazon, get your own house in order before asking us as sellers to defend you,” wrote one seller.

“I am personally sick of the condescending posts by Amazon management directed at us. We are not morons and know how to read and think for ourselves,” wrote another seller.

Mehta’s attempt to recruit Amazon’s third-party sellers into unpaid lobbyists follows a wider push by the company against The American Innovation and Choice Online Act. Last week, a public-facing post by Amazon’s VP of Public Policy Brian Huseman warned of potentially degraded Prime membership benefits for customers if the bill passes into law; similar to Mehta, Huseman also suggested anti-trust action might "make it difficult to justify the risk of Amazon offering a marketplace in which selling partners can participate."

The Senate bill contains provisions intended to prevent tech giants like Amazon and Google from giving their own services preferential treatment, thus putting other businesses at a disadvantage. Amazon over the years has been accused of using a number of tactics to put third-party merchants at a disadvantage, including using sales data on third-party products to develop its own competing products and prioritizing products that use Prime shipping in search results.

Trade groups funded by Big Tech have spent millions in ads that frame the bill as an “innovation killer” and harmful to small businesses, reported the Washington Post. The ads run primarily in states represented by vulnerable Senate Democrats, in an effort to amp up pressure from their own constituents. The Senate is expected to vote on the S.2992 sometime this summer. The House Judiciary Committee passed a similar bill last year, but it has yet to be scheduled for a floor vote.

Amazon is planning to appeal Staten Island union’s victory

Amazon will reportedly object to a recent union election victory at its warehouse in Staten Island, alleging that organizers pressured workers into voting to organize. The Wall Street Journal reported that the company revealed its intention to appeal JFK8’s election in a legal filing released to the public on Thursday. Roughly 55 percent of workers at the JFK8 warehouse voted to join the Amazon Labor Union, the first victory of its kind for Amazon workers in the US. The company has until April 22nd to gather evidence and formally file its objections to the National Labor Relations Board (NLRB).

In the document, Amazon gave a preview of what objections it plans on raising. The company wrote that it believes that the union threatened employees unless they voted to unionize. Some may think this is a fairly ironic move on Amazon’s part, considering NLRB accused the company of threatening employees unless they did the opposite. Amazon also accused the union of “electioneering” or interfering while employees waited in line to vote. It argued that unusually long waits at polling booths led to insufficient voter turnout. The company also believes organizers loitered by the polling area and intimidated voters, even going as far as to threaten immigrant employees with the loss of their rights if they didn’t vote to unionize.

Eric Milner, an attorney who represents the ALU, believes that Amazon’s objections will be dismissed. "To say that the Amazon Labor Union was threatening employees is really absurd," Milner said to Reuters. "The Amazon Labor Union is Amazon employees."

Meanwhile, a separate labor union attempting to organize an Amazon facility in Alabama filed its own objections on Thursday regarding the pending results of its recent rerun election. The Retail, Wholesale and Department Store Union (RWDSU) is accusing Amazon of “countless attempts to intimidate workers” in the Bessemer plant, including firing or suspending workers who supported the union. The results of that election are currently too close to call and will be determined in the coming weeks by an NLRB hearing over several hundred challenged ballots.

“Amazon’s behavior must not go unchallenged, and workers in Bessemer, Alabama must have their rights protected under the law. We urge the NLRB to carefully review our objections and ensure no company, not even with the bottomless pockets of Amazon, is allowed to act above the law,” said RWDSU president Stuart Appelbaum in a statement.

Amazon allegedly called union organizers ‘thugs’ to discourage workers from unionizing

The National Labor Relations Board has accused Amazon of threatening, surveilling and interrogating workers at its JFK8 warehouse in New York to discourage them from unionizing. According to the board's complaint as seen by Motherboard, Amazon brought a union avoidance consultant to the facility and told employees that it "would be futile for them to select the Union as their bargaining representative." The consultant reportedly said that union organizing at the warehouse would fail anyway, because the organizers were "thugs."

NLRB's complaint also said that Amazon representatives interrogated workers about union activities and promised to fix their issues if they didn't support the union and didn't distribute union literature. Further, the labor board alleges that security guards confiscated union literature from workers and told them they couldn't distribute the materials without permission. If you'll recall, Amazon's warehouse workers in New York filed a petition to unionize with the board last year, but they had to withdraw it after failing to gather enough signatures to be approved. The JFK8 workers re-filed their application in December and recently reached union vote threshold.

Amazon spokesperson Kelly Nantel denied the allegations to Motherboard, telling the publication: "These allegations are false and we look forward to showing that through this process."

These allegations come from a series of unfair labor practice charges filed by workers in May and June last year. The board investigated the incidents and found merit that they occurred. It has given Amazon February 10th to respond to the complaint and has set a hearing for it on April 5th. In addition to detailing workers' allegations in its complaint, the NLRB has also outlined a series of remedies it wants the company to follow. In particular, it wants Amazon to train its managers, supervisors, security guards and union avoidance consultants on workers' rights to organize and form unions.

This may also be a good pick for an era of remote work and virtual friend visits, as an ultra-wide 12MP front camera offers Center Stage to keep you in view as you move around.

Just don't expect a revamp on par with the new iPad mini or 2020's iPad Air. You won't find an all-screen design, USB-C, second-generation Pencil support or an improved rear camera. This is for anyone who wants a no-frills tablet that should still last a long while — if that's all you're looking for, you'll probably be happy.

Amazon explains outage that took out a large chunk of the internet

Amazon has explained the Web Services outage that knocked parts of the internet offline for several hours on December 7th — and promised more clarity if this happens in the future. As CNBCreports, Amazon revealed an automated capacity scaling feature led to "unexpected behavior" from internal network clients. Devices connecting that internal network to AWS were swamped, stalling communications.

The nature of the failure prevented teams from pinpointing and fixing the problem, Amazon added. They had to use logs to find out what happened, and internal tools were also affected. The rescuers were "extremely deliberate" in restoring service to avoid breaking still-functional workloads, and had to contend with a "latent issue" that prevented networking clients from backing off and giving systems a chance to recover.

The AWS division has temporarily disabled the scaling that led to the problem, and won't switch it back on until there are solutions in place. A fix for the latent glitch is coming within two weeks, Amazon said. There's also an extra network configuration to shield devices in the event of a repeat failure.

You might have an easier time understanding crises the next time around. A new version of AWS' service status dashboard is due in early 2022 to provide a clearer view of any outages, and a multi-region support system will help Amazon get in touch with customers that much sooner. These won't bring AWS back any faster during an incident, but they may eliminate some of the mystery when services go dark — important when victims include everything from Disney+ to Roomba vacuums.

That could make it a solid bargain if you're looking for a high-end, fitness-focused activity tracker from a well-known name. The Inspire 2 is also down to $ 60 (normally $ 100) if you're happy with the essentials.

The Charge 5 ticks many of the boxes if you're determine to stay in shape. The extensive fitness and health tracking features help, particularly if you get the advanced data from Fitbit Premium. You can optimize your workout performance and understand your sleep quality, for instance. You can track your stress in addition to heart rate and blood oxygen level, and you'll have perks like GPS, Fitbit Pay and multi-day battery life.

There are limitations. Fitbit doesn't share activity data with Apple Health or Google Fit, and you can't steer music from the tracker's screen. There's also the matter of competition: you can find some close-enough alternatives from companies like Amazfit, Xiaomi and Amazon itself that will cost less (at least up front) if you can do without some frills. Fitbit's experience in the field matters, though, and the sale price makes the Charge 5 considerably more tempting.
