The New York Times is suing OpenAI and Microsoft for copyright infringement

The New York Times is suing OpenAI and Microsoft for using published news articles to train its artificial intelligence chatbots without an agreement that compensates it for its intellectual property. The lawsuit, which was filed in a Federal District Court in Manhattan, marks the first time a major news organization has pursued the ChatGPT developers for copyright infringement. The NYT did not specify how much it seeks in payout from the companies but that “this action seeks to hold them responsible for the billions of dollars in statutory and actual damages.”

The NYT claims that OpenAI and Microsoft, the makers of Chat GPT and Copilot, “seek to free-ride on The Times’s massive investment in its journalism” without having any licensing agreements. In one part of the complaint, the NYT highlights that its domain (www.nytimes.com) was the most used proprietary source mined for content to train GPT-3.

It alleges more than 66 million records, ranging from breaking news articles to op-eds, published across the NYT websites and other affiliated brands were used to train the AI models. The lawsuit alleges that the defendants in the case have used “almost a century’s worth of copyrighted content,” causing significant harm to the Times’ bottom line. The NYT also says that OpenAI and Microsoft’s products can “generate output that recites Times content verbatim, closely summarizes it, and mimics its expressive style.” This mirrors other complaints from comedians and authors like Sarah Silverman and Julian Sancton who claim OpenAI has profited off their works.

"We respect the rights of content creators and owners and are committed to working with them to ensure they benefit from AI technology and new revenue models," an OpenAI spokesperson told Engadget. In an email, the representative explained that the two parties were engaged in ongoing "productive conversations" and the company described the lawsuit as unexpected. "We are surprised and disappointed with this development," the OpenAI spokesperson told Engadget. Still, OpenAI is hopeful that the two will find a "mutually beneficial way to work together."

If the lawsuit makes any headway, it could create opportunities for other publishers to pursue similar legal action and make training AI models for commercial purposes more costly. Competitors in the space, like CNN and BBC News have already tried limiting what data AI web crawlers can scrape for training and development purposes.

While it’s unclear if the NYT is open to a licensing agreement after its earlier negotiations failed, leading to the lawsuit, OpenAI has reached a few deals recently. This month, it agreed to pay publisher Axel Springer for access to its content in a deal projected to be worth millions. And articles from Politico and Business Insider will be made available to train OpenAI’s next gen AI tools as part of a three year deal. It also previously made a deal with the AP to use its archival content dating back to 1985. Microsoft did not respond to a request for comment.

Tesla denies firing New York workers in retaliation for union activity

Tesla has denied that it terminated employees at its Buffalo, New York Autopilot facility in response to a new union campaign. Days after workers at the facility sent a letter to company chief Elon Musk stating their intention to unionize, the campaign's organizers accused the automaker of illegally terminating employees in retaliation. In a blog post, Tesla called their accusation a "false allegation" and said that those who were let go lost their jobs because of their own doing. 

The company explained that it conducts performance reviews every six months and that workers are graded 1 to 5 for each cycle. It "helps them calibrate their work," Tesla wrote, and they will be let go if they fail to meet their performance expectations. These reviews are apparently conducted everywhere Tesla has a facility, with the most recent cycle covering July 2022 through December 2022. Tesla said it identified the people who will be let go on February 3rd, over a week before organizers sent their letter to Musk, and that managers were told way back in December that low performers will start exiting the company on the week of February 12th.

Moreover, the company explicitly stated that 4 percent of the employees on the Autopilot labeling team was let go due to their poor performance reviews. (Tesla said it only learned in hindsight that one out of the 27 impacted employees is part of the union campaign.) They received prior feedback, Tesla said, but "they did not demonstrate sufficient improvement." If you'll recall, the union organizers in Buffalo are in charge of labeling data for Autopilot. They previously told Bloomberg that they're fighting for better pay and working conditions that reduce production pressures. 

The workers said Tesla monitors their keystrokes to determine how much time they spend on each task and how many hours they spend working in a day. They've reportedly been skipping bathroom breaks, as a result. But in Tesla's response, it said that time monitoring is only there "to calculate how long it takes to label an image," so "there is nothing to be gained by delaying bathroom breaks." The report that Tesla pressures its employees is "categorically false," it added. Tesla didn't mention anything regarding the employees' complaint about not having a voice in the company's though: Workers previously said that talks of forming a union began after management shut down an internal chatroom where they can air their grievances.

Another Amazon warehouse in New York is seeking to unionize

Workers at an Amazon warehouse in a town located southeast of Albany, New York have filed a petition with the National Labor Relations Board to hold a union election. The warehouse, with the codename ALB1, is hoping to join the Amazon Labor Union, which successfully convinced majority of workers at the company's JFK8 facility in Staten Island to vote in favor of unionizing earlier this year. An NLRB spokesperson told CNBC that the agency's office in Buffalo is currently verifying whether the group has truly met the minimum number of signatures needed to hold an election.

Unions typically need to get signatures from 30 percent of eligible members to be able to hold a vote. According to The Washington Post, the ALU previously said that it had passed that threshold for the Albany warehouse. Union organizers at the facility have been working on joining the ALU for months. After Amazon noticed their efforts, the company reportedly held meetings to discourage workers from unionizing. An employee also sent us photos of digital TVs at the Albany facility displaying anti-union messages. To be precise, the messages discouraged people from signing a "card" from the ALU, pertaining to the authorization cards workers have to sign for the warehouse to be able to hold a vote.

The ALU has been demanding for higher pay and safer working conditions for warehouse workers and has previously accused the company of retaliation. A few weeks after it won the election in Staten Island, Amazon fired two of the employees who were involved in its organization efforts. Their fellow organizers believed that it was a retaliatory move by the e-commerce giant. Heather Goodall, a lead organizer at ALB1, said: "The main concerns I hear from workers are about wages and safety. Besides that, there’s no job security. There’s no way to rest on a 15-minute break. Workers want to be able to use the bathroom freely."

Amazon has long made it clear that it is against workers' unionization efforts. A spokesperson told The Post: “As a company, we don’t think unions are the best answer for our employees. Our focus remains on working directly with our team to continue making Amazon a great place to work." The company also appealed ALU's victory in Staten Island, accusing organizers of pressuring workers to vote in favor unionizing. A hearing for Amazon's appeal could be announced sometime this month.
