Court orders Elon Musk to testify in the SEC’s investigation of his Twitter takeover

In a followup to a tentative ruling made in December, a federal judge has ordered Elon Musk to comply with the U.S. Securities and Exchange Commission’s (SEC) subpoena and testify again in its probe of his Twitter takeover, Reuters reports. Per the order, which was filed Saturday night in a California court, Musk and the SEC now have a week to work out a time and place for his appearance or it will be decided for them. The SEC has been investigating Musk’s purchase of Twitter, now X, since 2022 over concerns about his lateness in disclosing his stake in Twitter.

The order comes after Musk failed to appear for a testimony in September and later refused to attend a rescheduled interview, prompting the SEC to sue. US Magistrate Judge Laurel Beeler sided with the SEC after Musk tried to challenge its subpoena, which he claims is seeking irrelevant information and is harassment, as he’s already been interviewed twice. But, the SEC says it has obtained new documents in relation to the probe and has further questions for the X owner. Musk also argued that the subpoena exceeds the SEC’s authority because it was issued by a staff member appointed by the SEC’s Director of Enforcement. Beeler struck these arguments down, ruling that the subpoena is valid.

Humane AI Pin orders will start shipping in March

The Humane AI Pin is expected to start shipping in March. On Friday, the company posted on X (Twitter) that “those who placed priority orders will receive their Ai Pins first when we begin shipping in March.” The company had previously given an “early 2024” estimate for the screen-less wearable device designed to replace a smartphone.

Humane, founded by former Apple employees Bethany Bongiorno and Imran Chaudhri, views the smartphone (still their ex-employer’s bread and butter) as on its last legs. “The last era has plateaued,” TechCrunch reported Chaudhri as saying in a November press briefing. He views the AI-powered wearable product as “a new way of thinking, a new sense of opportunity.”

The $ 699 Humane AI Pin doesn’t have a screen; instead, it relies on voice cues and a projector that beams relevant info onto the user’s hand. The founders flaunt the device’s privacy focus combined with contextual intelligence, promising it “quickly understands what you need, connecting you to the right AI experience or service instantly.” Partnerships with OpenAI, Microsoft and Tidal provide what the company calls “access to some of the world’s most powerful AI models and platforms.”

The pin runs on a quad-core Snapdragon processor with a dedicated Qualcomm AI Engine powering its Cosmos OS software. It ships in three color options, two of which add an extra $ 100 to its price. Buyers must pay $ 24 monthly to access the pin’s cellular data, built as an MVNO (mobile virtual network operator) on top of T-Mobile’s network.

In addition to providing the March shipping date, Humane says the remaining orders will continue to roll out in the order they were received. Engadget emailed the company to ask when it expects current orders to go out, and we’ll update this article if it responds.

The Humane AI Pin is available to pre-order now from Humane’s website. The Eclipse (matte black on black) costs $ 699, while Lunar (polished chrome on white) and Equinox (polished chrome on black) colorways will set you back $ 799.

FTC orders Mastercard to open debit transactions to competing payment networks

The Federal Trade Commission has ordered Mastercard to start providing competing payment networks with the information they need to process debit card payments. In a proposed enforcement action announced on Friday, the FTC said Mastercard had allegedly violated a provision of the Dodd-Frank act known as the Durbin Amendment by prohibiting merchants from routing transactions over alternative networks.

The action targets “tokenization,” the technology that underpins mobile payment applications like Apple Pay, Google Pay and Samsung Pay. When you go to make a debit or credit card purchase with your phone’s mobile wallet, the software substitutes sensitive information, including the primary number associated with your account, with a separate set of single-use “tokens.” Mastercard and Visa say the practice prevents fraud since tokens contain no exploitable information when they’re in transit. It’s only when they arrive at Mastercard or Visa’s servers, and they’re mapped back to their original account holder, that they point to someone.

According to the FTC, Mastercard has historically stopped competing networks from accessing its token vault. That means whenever consumers decided to pay with a mobile wallet, merchants had to route the transactions over Mastercard (or Visa) and pay the company's transactions fees, which are typically higher than that of its competitors. The Durbin Amendment calls for banks to support two competing payment networks on all debit cards. It was a provision Congress introduced to promote competition among networks. The FTC didn’t say if it reached a similar agreement with Visa.

“While we are taking these steps to bring this matter to a close, there should be no question that tokenized transactions provide an increased level of protection to both consumers and merchants,” Mastercard spokesperson Seth Eisen told Bloomberg. “This focus on security guides our efforts in a highly competitive market and provides the incentive for us to continue investing in innovations that promote the peace of mind every person expects.” Eisen added Mastercard would “continue to work to update our processes to comply with the consent order and provide even greater choice.”

The FTC plans to collect comments from the public before voting to finalize the order against Mastercard.

Apple orders season two of historical drama ‘Pachinko’

Apple is moving forward with a second season of its critically-acclaimed adaption of Min Jin Lee’s best-selling novel Pachinko. The company announced the renewal shortly before the show’s season one finale premiered this past Friday on Apple TV+.

Published in 2017, Lee’s multi-generational tale won accolades for its portrayal of a Korean family that immigrates to Japan before the outbreak of the Second World War. What’s striking about both the novel and Apple’s drama series is how they effortlessly weave history and the deeply personal stories of their characters together. From Japanese colonialism in Korea to the atomic bombings of Hiroshima and Nagasaki, and later Japan’s economic boom in the 1980s, history has a profound effect on Pachinko’s characters and yet the story always feels intimate.

Friday’s season one finale pulled from a scene that occurs about a third through Lee’s approximately 500-page novel, so there’s plenty of story left for Apple’s TV+ series to adapt. The company didn’t say when season two will begin filming or when it plans to stream the new episodes. All of that just means you have time to catch up on Pachinko if you’ve been sleeping on it.
