Apple reaches possible settlement with the startup it sued for trade secret theft

Apple has reached a possible settlement with Rivos, the Mountain View startup it accused in 2022 of poaching its employees and stealing its trade secrets. In the companies' filing seen by Bloomberg and Reuters, they told the US District Court for the Northern District of California that they have signed an agreement that "potentially settles the case." Their deal would allow Apple to conduct a forensic examination of Rivos' systems, as well as of its activities. 

When the iPhonemaker sued Rivos, it said the startup led a "coordinated campaign" to hire away employees from its chip design division. Apple also accused the defendant of instructing the employees it hired away to steal presentations and other proprietary information for unreleased iPhone chip designs that cost billions of dollars to develop. Rivos countersued Apple last year, accusing the larger company of restricting employees' ability to work elsewhere and of hindering emerging startups' growth by using anticompetitive measures. 

The court dismissed Apple's trade secret claims against Rivos in April 2023, though the company was allowed to file a revised complaint. Apple already settled with its six former employees who filed a countersuit against the iPhonemaker along with Rivos after they dropped their claims against each other last month. Both companies are now requesting the court to put their cases on hold until March 15, when they expect the settlement to be completed.

Apple reaches $25M settlement with the DOJ for discriminating against US residents during hiring

Apple will pay $ 25 million in backpay and civil penalties to settle allegations that it favored visa holders and discriminated against US citizens and permanent residents during its hiring process, the Department of Justice said in a statement on Thursday. This is the largest amount that the DOJ has collected under the anti-discrimination provision of the Immigration and Nationality Act.

At the heart of the issue is a federal program administered by the Department of Labor and the Department of Homeland Security called the Permanent Labor Certification Program (PERM). PERM allows US employers to file for foreign workers on visas to become permanent US residents. As part of the PERM process, employers are required to prominently advertise open positions so that anyone can apply to them regardless of citizenship status.

The DOJ said that Apple violated these rules by not advertising PERM positions on their recruiting website, and also made it harder for people to apply by requiring mailed-in paper applications, something that it did not do for regular, non-PERM positions. As a result, a DOJ investigation found that Apple received few or no applications for these positions from US citizens or permanent residents who do not require work visas.

As part of the settlement, Apple will pay $ 6.75 million in civil penalties and set up a $ 18.25 million fund to pay back eligible discrimination victims, the DOJ’s statement said. 

Apple disagreed with the DOJ’s characterization. “Apple proudly employs more than 90,000 people in the United States and continues to invest nationwide, creating millions of jobs,” a company spokesperson told CNBC. “When we realized we had unintentionally not been following the DOJ standard, we agreed to a settlement addressing their concerns. We have implemented a robust remediation plan to comply with the requirements of various government agencies as we continue to hire American workers and grow in the US”

Queen’s iconic “Bohemian Rhapsody” video reaches historic 1 billion views milestone on YouTube

Queen’s iconic music video for “Bohemian Rhapsody” has now officially passed one billion views on YouTube, making history as the first pre-1990s video to reach one billion views on the platform.

The accompanying video for Queen’s 1975 single, “Bohemian Rhapsody,” is generally recognized as the first-ever promotional music video, kick-starting and setting the gold-standard for the genre for decades to come. Today, it continues to inspire and entertain millions of fans around the world, more than 40 years after it was first created.

To celebrate this monumental achievement, a newly remastered HD version of the video is available today, for the first time ever and exclusively on the bands’ YouTube channel. Fans can now see the video restored in all its glory, as it was originally intended. Additionally, fans will now be able to access the song’s lyrics in multiple languages including English, Spanish, Italian, French, Japanese, Polish, German, Indonesian Bahasa, Korean, Czech, Russian and Turkish while watching the video.

To further honor this significant milestone, Queen — in partnership with YouTube Music, Universal Music Group and Hollywood Records — have announced the launch of ‘You Are The Champions,’ a unique new campaign that will give fans an exclusive chance to become a part of Queen history with a starring role in three brand-new, user-generated videos for three of the band’s most celebrated tracks. The campaign launches later this month, so stay tuned for more details.

As part of the campaign, musicians, singers, and instrumentalists can take on “Bohemian Rhapsody.” Dancers will be able to give their own interpretations for “Don’t Stop Me Now,” with a special instructional video created by Polly Bennett (Rami Malek’s movement coach from the hit film, “Bohemian Rhapsody”). And, finally, visual artists will get the chance to design any word or phrase from the lyrics of “A Kind of Magic.”

The song has continued to inspire a new generation of fans following the unprecedented global success of last year’s biographical film “Bohemian Rhapsody,” which tells the incredible story of the band’s career, as well as the genesis of the song. The film is the highest-grossing music biopic in history, having generated more than $ 900 million dollars at the box office.
