Biden signs executive order to stop Russia and China from buying Americans’ personal data

President Joe Biden has signed an executive order that aims to limit the mass-sale of Americans’ personal data to “countries of concern,” including Russia and China. The order specifically targets the bulk sale of geolocation, genomic, financial, biometric, health and other personally identifying information.

During a briefing with reporters, a senior administration official said that the sale of such data to these countries poses a national security risk. “Our current policies and laws leave open access to vast amounts of American sensitive personal data,” the official said. “Buying data through data brokers is currently legal in the United States, and that reflects a gap in our national security toolkit that we are working to fill with this program.”

Researchers and privacy advocates have long warned about the national security risks posed by the largely unregulated multibillion-dollar data broker industry. Last fall, researchers at Duke University reported that they were able to easily buy troves of personal and health data about US military personnel while posing as foreign agents.

Biden’s executive order attempts to address such scenarios. It bars data brokers and other companies from selling large troves of Americans’ personal information to countries or entities in Russia, China, Iran, North Korea, Cuba and Venezuela either directly or indirectly. There are likely to be additional restrictions on companies’ ability to sell data as part of cloud service contracts, investment agreements and employment agreements.

Though the White House described the step as “the most significant executive action any President has ever taken to protect Americans’ data security,” it’s unclear how exactly enforcement of the new policies will be handled within the Justice Department. A DoJ official said the executive order would require due diligence from data brokers to vet who they are dealing with, similar to the way companies are expected to adhere to US sanctions.

As the White House points out, there are currently few regulations for the multibillion-dollar data broker industry. The order will do nothing to slow the bulk sale of Americans’ data to countries or companies not deemed to be a security risk. “President Biden continues to urge Congress to do its part and pass comprehensive bipartisan privacy legislation, especially to protect the safety of our children,” a White House statement says.

Utah sues TikTok over child safety issues and its links to China

Utah has sued TikTok over child safety issues and the company’s China-based ownership, CNBC has reported. In the complaint, attorney general Sean Reyes called the app “an addictive product” and accused it of misleading users about its relationship with China-based parent company ByteDance. The state recently enacted some of the strictest social media laws in the country, requiring parental permission for teens to use social media. 

The lawsuit compares TikTok to a slot machine that provides “dopamine manipulation” trigged by swiping up on videos. That addictive nature is particularly harmful for the “not-yet-fully-developed” brain of young users and can create a dependence on the app, the state claims. It noted that the US Surgeon General has warned about mental health harms around social media, and cited excessive TikTok usage based around the company’s own (redacted) figures. 

“What these children (and their parents) do not know is that TikTok is lying to them about the safety of its app and exploiting them into checking and watching the app compulsively, no matter the terrible effects it has on their mental health, their physical development, their family, and their social life,” the complaint states. 

The lawsuit also delves into TikTok’s links to China. “To avoid scrutiny from its users (and regulators), TikTok has also misled Utah consumers about the degree to which TikTok remains enmeshed with and under the control of ByteDance, it’s China-based parent company.” 

TikTok previously said that it has dedicated more than $ 1.5 billion on data security, and has rejected allegations that it’s spying for the Chinese government. The company also recently opened a Transparency and Accountability Center in an effort to fend off regulators and potential bans.

The federal government has yet to take any concrete action against social media platforms, but states have been more active. Utah recently passed a law requiring parents to get permission before teens can create accounts on TikTok, Snap and other platforms. It also mandates curfew, parental controls and age verification features. The state didn’t go as far as Montana, however, which outright banned the use of TikTok. Tomorrow, a judge will hear arguments in TikTok’s lawsuit seeking to overturn that ban — a case that could open the company up to more scrutiny and set precedent around the US.

Commerce Department limits sale of hacking tools to Russia and China

The US Commerce Department has announced new rules related to the export and resale of cyber intrusion software. Once the limits come into effect in 90 days, companies that want to sell their hacking tools to countries “of national security or weapons of mass destruction concern” will need to obtain a license from the department’s Bureau of Industry and Security (BIS). The policy also covers nations that are under a US arms embargo.

Per The Washington Post, the rule is complicated. There are already many limitations on the export of intrusion software. Similarly, there are opportunities for companies to obtain exceptions. The main point is that the policy would cover the sale of software to countries like China and Russia. It would also limit the sale of programs like NSO’s Pegasus spyware, which some governments have used to target dissidents and journalists.

“The United States Government opposes the misuse of technology to abuse human rights or conduct other malicious cyber activities, and these new rules will help ensure that US companies are not fueling authoritarian practices,” the Commerce Department said.

Among the 42 countries involved in the Wassenaar Arrangement, a pact that sets voluntary export controls on military and dual-use technologies, the US is one of the last to impose limits on the sale of hacking software. Part of the reason for that is that the country has spent years working on the rules to ensure they don’t prevent cybersecurity researchers across the globe from working together to discover new flaws.

Apple Announces New Environmental Initiatives in China

Apple today announced an expansion of its renewable energy and environmental protection initiatives in China, including a new multiyear project with World Wildlife Fund to significantly increase responsibly managed forests across China. The new program aims to protect as much as 1 million acres of responsibly managed working forests that provide fiber for pulp, paper, and wood products. “Forests, like energy, can be renewable resources,” said Lisa Jackson, Apple’s vice president of Environmental Initiatives. “We believe we can run on naturally renewable resources and ensure that we protect — and create — as much sustainable working forest as needed to produce the virgin paper in our product packaging.” Apple also announced its intent to expand its industry-leading renewable energy projects to manufacturing facilities in China.
